We do not knowingly collect Personal Information from children under 13, and we do not knowingly sell or share the Personal Information of anyone under 16. If you are a parent or guardian and believe your child has provided us with Personal Information, please contact us using the details above and we will delete it.
Sharing Personal Information
We share your Personal Information with service providers who help us run our business and fulfill our contracts with you, as described above. For example:
- We use Shopify to power our online store. You can read more about how Shopify uses your Personal Information here: https://www.shopify.com/legal/privacy. Shopify may also use store data to improve its products, fraud protection, and ad targeting as described in Shopify’s Additional Services Terms.
- We use payment processors, shipping carriers, our fulfillment warehouse, and returns, tax, accounting, and fraud-screening services to complete and support your order.
- We use email, messaging, and form providers to communicate with you.
- We run affiliate and creator programs through UpPromote and Shopify Collabs. When you arrive through an affiliate link, these services record the referral and any resulting purchase so the affiliate can be credited.
- We may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful request, to protect our rights, or as part of a sale, merger, or reorganization of our business.
Behavioral Advertising
We use your Personal Information to show you advertisements and marketing communications we believe may interest you, and to measure how well our ads work. For example:
- We use Google Analytics to understand how customers use the Site, and Google Ads and YouTube to advertise. You can read how Google uses your information here: https://policies.google.com/privacy. You can opt out of Google Analytics here: https://tools.google.com/dlpage/gaoptout.
- We use the Meta pixel to measure and target ads on Facebook and Instagram.
- We use the TikTok pixel, including server-side event sharing, to measure and target ads on TikTok.
- These advertising partners may receive information about your use of the Site, your purchases, and your interaction with our ads, and in some cases hashed contact details such as your email address or phone number so they can match activity to their users. They may collect this information over time and across different websites.
For more information about how targeted advertising works, you can visit the Network Advertising Initiative’s educational page at https://thenai.org/about-online-advertising/.
You can opt out of targeted advertising by:
- Google: https://myadcenter.google.com/
- Facebook and Instagram: https://www.facebook.com/adpreferences/ad_settings
- TikTok: in the TikTok app, under Settings and privacy, then Ads
- Using the “Your privacy choices” link in our Site footer, where available in your state, or by emailing us at info@thebonsaisupply.com
Additionally, you can opt out of some of these services through the Digital Advertising Alliance’s opt-out portal at https://optout.aboutads.info/ and the Network Advertising Initiative’s opt-out page at https://optout.networkadvertising.org/.
Using Personal Information
We use your Personal Information to provide our products and services to you, which includes offering products for sale, processing payments, shipping and fulfilling your order, handling returns, preventing fraud, keeping our business records, and keeping you up to date on new products, services, and offers.
Marketing emails and texts
We send marketing emails and texts only if you sign up for them. You can unsubscribe from marketing emails at any time using the link at the bottom of any email, and from texts by replying STOP. We will still send messages about your orders.
Retention
We keep order and transaction records for as long as we need them for tax, accounting, and legal purposes, which is generally at least seven years. We keep other Personal Information for as long as we have a business need for it, or until you ask us to delete it, unless we are required by law to keep it.
Security
We use reasonable safeguards to protect your Personal Information, and our payment processors handle card data under industry security standards. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
Automatic decision-making
We do not engage in fully automated decision-making that has a legal or otherwise significant effect on you.
Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you. This includes a temporary block of IP addresses associated with repeated failed transactions, which lasts a small number of hours, and a temporary block of credit cards associated with blocked IP addresses, which lasts a small number of days.
Selling and Sharing Personal Information
We do not sell your Personal Information for money. Some state privacy laws treat sharing data with advertising partners through cookies and pixels, for targeted advertising, as a “sale” or “sharing” of Personal Information. In the past 12 months, we have shared device and browsing information, purchase activity, and identifiers with Google, Meta, and TikTok for this purpose, as described under “Behavioral Advertising.” You can opt out at any time using the “Your privacy choices” link in our Site footer, where available in your state, or by emailing us. We do not offer any financial incentive in exchange for your Personal Information.

Depending on the state you live in, you may have the right to:
- Know what Personal Information we hold about you and get a copy of it in a portable format.

- Opt out of targeted advertising and the “sale” or “sharing” of your Personal Information.

If we decline your request, you may appeal by replying to our decision with the subject line “Privacy appeal,” and we will respond in writing within the time the law requires. We will not discriminate against you for exercising any of these rights.
Residents of the European Economic Area and the United Kingdom
If you are a resident of the EEA or the UK, we process your Personal Information under the following lawful bases:
- Your consent, for marketing emails and texts and for advertising cookies where consent is required;
- The performance of the contract between you and us, to process and deliver your order;
- Compliance with our legal obligations, such as tax and accounting records;
- Our legitimate interests in running, securing, and improving our business, which do not override your fundamental rights and freedoms.
You have the right to access the Personal Information we hold about you, to port it to a new service, to ask that it be corrected, updated, or erased, to restrict or object to our processing of it, and to withdraw your consent at any time. To exercise these rights, contact us using the details above.
We are located in the United States, and your Personal Information is processed and stored in the United States and in other countries where our service providers operate. For more information on how Shopify handles international data transfers, see Shopify’s privacy policy: https://www.shopify.com/legal/privacy.
Cookies
A cookie is a small amount of information that is downloaded to your computer or device when you visit our Site. We use several types of cookies:
- Necessary cookies set by Shopify that make the store work, such as the shopping cart, checkout, login, and your privacy preferences.
- Analytics cookies set by Shopify and Google Analytics that tell us how visitors use the Site.
- Advertising cookies and pixels set by Google, Meta, and TikTok that measure and target our ads.
- Affiliate cookies set by UpPromote and Shopify Collabs that credit affiliates for referrals.
You can see the current list of cookies Shopify uses on storefronts here: https://www.shopify.com/legal/cookies.
The length of time that a cookie remains on your computer or mobile device depends on whether it is a “persistent” or “session” cookie. Session cookies last until you stop browsing, and persistent cookies last until they expire or are deleted. Most of the cookies we use are persistent and expire between 30 minutes and two years from the date they are downloaded to your device.
You can control and manage cookies in various ways. Most browsers automatically accept cookies, but you can choose whether or not to accept cookies through your browser settings, often found in your browser’s “Settings,” “Tools,” or “Preferences” menu. More information is available at www.allaboutcookies.org. Removing or blocking cookies can affect your experience, and parts of the Site may not work fully.
Blocking cookies may not completely prevent how we share information with advertising partners. To opt out of those uses, please follow the instructions in the “Behavioral Advertising” section above.
Do Not Track
Because there is no consistent industry understanding of how to respond to “Do Not Track” signals, we do not alter our data collection and usage practices when we detect such a signal from your browser.
Changes
We may update this Privacy Policy from time to time to reflect changes to our practices or for other operational, legal, or regulatory reasons. When we do, we will post the updated policy on this page and change the “Last updated” date below.
Complaints
If you would like to make a complaint, please contact us using the details under “Contact” above.
If you are not satisfied with our response, you may contact the consumer protection office of your state Attorney General. In Texas, that is the Office of the Attorney General’s Consumer Protection Division: https://www.texasattorneygeneral.gov/consumer-protection. If you live in the EEA or the UK, you may also lodge a complaint with your local data protection authority.
